General Terms and Conditions of Caresse Cosmetics BV

These are our general terms and conditions. Together with the references they contain, they apply to any agreement we, Caresse Cosmetics BV (with Chamber of Commerce number: 3416 6389), enter into with you. You can also reach us by phone at +31(0)23 542 89 80. We reserve the right to amend these general terms and conditions. You agree that the latest version of these general terms and conditions will always apply to our agreement.

Article 1 – Products

We sell sun care products, such as Coconut Tanning Oil, Sunlotion, Aftersun. Additionally, we offer beach accessories, such as bracelets, beach bags, and beach towels. 

Article 2 – Registration

You must register to order a product. To do so, you must provide us with your personal information. You are required to provide accurate and up-to-date personal information. We protect your personal information; please refer to our Privacy Statement on our website. Use a strong password for your account and never share your password with others. You are responsible for any misuse of your account (e.g., if someone else places an order with us using your password). Your personal information will be stored and used in accordance with the General Data Protection Regulation (GDPR) for processing your order and any customer service-related communication.

Article 3 – Payments

The (total) price of the products is indicated in our webshop in EURO. You can pay in our webshop using iDeal, Bancontact, Apple Pay, Google Pay, and the following credit cards: Visa, Mastercard, and American Express. Shipping costs are at your expense unless you order above the minimum order amount for free delivery. Here you will find an overview of shipping costs per country. 

Article 4 – Deliveries

We will deliver the product to the address provided during the ordering process. You cannot change the address once we have dispatched the package. Distribution is handled by GLS or PostNL. We strive to deliver the order as quickly as possible, typically within 1 – 4 business days in NL. If there is a delay in the delivery, we will notify you accordingly. We guarantee that you will receive the order no later than 8 business days after order confirmation. If, for any reason, this is not achievable, you can request (a) an immediate refund of the amount paid for the product or (b) a replacement product (of equal value). In the event of lost or damaged packages during shipment, we will work with you to find a suitable solution, such as resending the product or refunding the purchase amount.

Article 5 – Returns

You may return the product within 14 days of receiving it, provided it is unused. You can initiate the return process by sending an email to info@caresse-cosmetics.nl. Upon receiving confirmation from us, you must return the product within 14 days. Once we receive the product, we will refund the full purchase amount within 7 business days. The cost of return shipping is your responsibility. During the period in which you have the right to reconsider whether to keep the product, you must handle the product and its packaging carefully. You may only unpack and open the product to the extent necessary to determine whether you want to keep it.

Article 6 – Liability

We are not liable for any damages caused by the use of a product, except in cases where such damage results from our intentional actions, gross negligence, or conscious recklessness. In any event, your right to compensation will be limited to the amount paid for the ordered product.

Article 7 – Intellectual Property Rights

All intellectual property rights (such as copyrights, trademarks, and other proprietary rights) in our texts, photos, images, and other materials are owned by us (or are under our management with the permission of the rights holder). Your use must not infringe upon these rights.
 

Article 8 – Complaints Procedure

If you have a complaint about the execution of the agreement, we would like to hear from you. You can use the contact form on our website or email your complaint (described as quickly and completely as possible) to info@caresse-cosmetics.nl. We will handle your complaint within 3 business days of receipt. If it takes longer to resolve the complaint, you will receive confirmation of your complaint within 3 business days, along with an indication of when we expect to provide a substantive response. If we cannot resolve the complaint amicably, it will become a dispute subject to the dispute resolution procedure.

Article 9 – Dispute Resolution

Dutch law applies to these general terms and conditions. In the event of a dispute, the court in North Holland has jurisdiction. By placing an order, you agree to these general terms and conditions.
